Governing Law

Unless mandatory provisions of law require otherwise, the relationship between Auctorum and its users, buyers and sellers shall be governed by the laws of the Republic of Estonia, without regard to any conflict-of-laws rules that would lead to the application of the laws of another jurisdiction.

Negotiations and Pre-Action Complaints

A party that considers its rights to have been infringed should, where reasonably possible, first submit a written complaint and allow the other party a reasonable period to respond and attempt an amicable out-of-court resolution.

The submission of a complaint shall not constitute a mandatory precondition to court proceedings where the law, the nature of the claim, or the urgency of the relief sought requires immediate recourse to the courts.

Jurisdiction

Unless mandatory provisions of law provide otherwise, any dispute shall be submitted to the courts of the Republic of Estonia having jurisdiction at the registered seat of Auctorum.

Auctorum shall also be entitled, to the extent permitted by law, to bring claims before the courts of the defendant’s domicile or registered office, the location of the relevant assets, or the place of performance of the relevant obligation.

Language of Documents

Auctorum may publish its documents in more than one language. Unless expressly stated otherwise, and unless mandatory provisions of law require a different approach, in the event of any discrepancy between language versions, the English-language version published by Auctorum for the relevant sale or document shall prevail.
